Q41: Except for the select few in the Netheril: Empire of Magic from 1996, are there any published spells in 3.0 or 3.5 (yeah, I know Netheril: Empire of Magic isn't either one) that are beyond level 9 for epic levels?
they changed that system in the transition to 3rd ed. Any spell that was formerly higher than nine is now just a straight epic spell. Lost Empires of Faerun and Magic of Faerun (3.5 and 3.0 respectively) reprinted most of those, if not all, from what I recall.

A gygaxian dungeon is like the world's most messed up game show.

Behind door number one: INSTANT DEATH!
Behind door number 2: A magic crown!
Behind door number 3: 4d6 giant bees, and THREE HUNDRED POUNDS OF HONEY!
They don't/haven't, was the point. 3.5 is as dead as people not liking nice tits.

Sometimes, their tits (3.5) get enhancements (houserules), but that doesn't mean people don't like nice tits.

Though sometimes, the surgeon (DM) botches them pretty bad...
Best metaphor I have seen in a long time.  I give you much fu.
Three Errata for the Mage-kings under the sky,
Seven for the Barbarian-lords in their halls of stone,
Nine for Mortal Monks doomed to die,
One for the Wizard on his dark throne
In the Land of Charop where the Shadows lie.

Q42
If a creature lacks a CON score, what abilities become CHA-based instead of CON-based?
Hood - My first answer to all your build questions; past, present, and future.

Speaking of which:
Don't even need TO for this.  Any decent Hood build, especially one with Celerity, one-rounds [Azathoth, the most powerful greater deity from d20 Cthulu].
Does it bug anyone else that we've reached the point where characters who can obliterate a greater deity in one round are considered "decent?"

As far as I know, only those explicitly noted as changing.

Repost and update:

Q 36: How does Bloodstorm Blade's ability to initiate a maneuver on a thrown attack interact with the Master Throwers trick shots? Specifically the one that lets you trip with a thrown weapon in the context of initiating a Setting Sun throw maneuver.

Pre-Edit: Scratch that. This wouldn't work even if it works. Bloodstorm Blade only lets you initiate Iron Heart strikes, not just any ones. Oh well. Assuming that it allowed you to initiate strikes from other schools, how would it still work?

Update: The Setting Sun throws just require you to make a melee touch attack and a trip attempt. The other BB lvl 2 ability lets you make a melee attack at range. If you're using a trip-capable weapon, like a spiked chain or a guisarme, you should be able to trip with it as a "melee" attack, right? If so, can you use a Setting Sun throw to trip an opponent and move him to within 10 feet of you?

Q 43 What's a good way to beat (or get time to escape from) high HD vermin as an Air Walking Cleric lvl 10? (assume no DMM and no domains and no feats, just the spell list) How about from angry druids?

The Repel Vermin spell.  I think it even works against vermin-shaped druids.

Q44: Aside from Incantatrix and Mage of the Arcane Order, is there any PrC that grants you free metamagic feats early?

What about the 'high HD vermin'? Repel Vermin blocks CL/3, which is only vermin with 3 or less HD.

Stolen from the Party Face thread:

Not too familiar with ToM, but can a binder/warlock get into anima mage?
Not without qualification tricks for spell casting of minimum level spells.

Q45: What qualifications tricks would work here?

I'm assuming Magical Training with Precocious Apprentice would work just fine but is there anything out there that would work for a non-human or non-elf (which is a prereq for Magical Training)?

They only get a saving throw, and their Will saves are downright terrible.

Q45: As I recall, there was at least one way, maybe a couple, of getting a shield to float about you, freeing your hands up for more important things. I think one of them was a shield enhancement, but I don't know. Thanks for whatever help you sages can provide.
Life should NOT be a journey to the grave with the intention of arriving safely in an attractive and well preserved body, but rather to skid in sideways, chocolate in one hand, martini in the other, body thoroughly used up, totally worn out and screaming WOO HOO what a ride!

When the dread necromancer gains 8th level, the Str and Dex go up by +2 for every HD they have, as well as when the animate dead spell is cast, you can control 4+CHA mod HD worth of undead per class level instead of just 4 HD worth. They gain a similar bonus for control undead, which is 2+CHA mod HD/level instead of 2 HD/level.

Rod of Undead Mastery doubles your control limits for Undead.
I am constantly amazed by how many DM's ban Tomb of Battle.  The book doesn't even exist!

Libris Mortis gave vampires a feat that'll let them survive for a few additional rounds, and Expedition to Castle Ravenloft gave them an artifact that'll make them completely immune.
