You can prepare spells of lower level in higher level slots, so I'd say yes.

That, and having BAB+6 doesn't disqualify you for having BAB+5

No. You can slap on a feat like Arcane Disciple or Mother Cyst to qualify, though.

In this particular example, the potential snag is the character *technically* has no 1st, 2nd, or 3rd level slots to fill as an Arcanist.

I would say it depends on how you get the spells. If it is like a wizard where you may learn a lower level spell in place of of a higher level spell you would only need to learn one of your 4th level spells as a 3rd level choice instead. You still wouldn't have the slot but could use a 4th level slot to cast it. You know have a 3rd level spell that should qualify you.
Clerics and Druids are like the 4 and 2 in 42. Together they are the answer to the ultimate question in D&D.
Retire the character before the DM smacks you with the Table as the book will feel totally inadequate now.-Hazren

Yes, but we're talking about a Nar Demonbinder. They have a fixed spell list, which doesn't include anything below 4th level. Nar Demonbinder was quite popular right after the UE book came out, and I saw a lot of builds jumping through hoops to use it to qualify for other PrCs (and made some myself). Arcane Disciple and Mother Cyst were the easiest, IIRC.

If it were a Sublime Chord, then yeah choosing a lower level spell known might work. (I forget what it takes to qualify for that PrC, though. You might be required to have 3rd level spells already, or something...)

Q 113: If the healer class was changed to add the spells from one domain, chosen at first level, to its spell list and was changed to a spontaneous caster that automatically knows all spells on its list, like beguiler or dread necromancer, what tier would it be in?  What if it added the spells from two or three domains instead of one?

Q 114:    The Swiftblade prestige class has two abilities:  Blurred Alacrity, which gives concealment to physical attacks; and Evasive Celerity, which gives "miss chance" against targeted spells.   Both of these abilities are Extraordinary.

Would the True Seeing spell be able to pierce this concealment?  What about Blindsight or Tremorsense?

A112: Aberrations get access to the feats Rapidstrike and Improved Rapidstrike, which instantly make playing a natural attack-based build far more frightening.

A114: There's nothing obscuring vision, so True Seeing has nothing to penetrate.  Tremorsense and Blindsight are more questionable, but since the miss chance is from the Swiftblade moving so fast, I doubt either work.
I am constantly amazed by how many DM's ban Tomb of Battle.  The book doesn't even exist!

Per-day. I don't think there are any really constant non-custom sources of touch attacks other than those you mentioned. Unless you count an item of permanent Wraithstrike for 8k.

Q 89 The exotic armor and shields section in Races of Stone has a Gauntlet Shield. It says it can hold things, but can't use weapons with it. However, it can perform somatic component spells, and hold onto various items. I read this as "can't use to fight with a light weapon in that hand" as opposed to "can't fight with weapons at any time, even when trying to power attack." Am I correct in my interpretation?
