I just noticed that too. I'm pretty sure he means the gargoyle, who's not an outsider.

You're about 40 feet above the trees, which makes you 105 feet off the ground. You'd hit the ground in one, maybe two rounds.

well i think i am better off with taking on the giant with limited flight (ya my cloak will help me get down but there is a limit on how long i can say up there other then summoning.

Although, we would have to talk him into that.
He's okay with it, it's just that he doesn't fly as perfectly as Melkior does. He flies 90 ft good.

I won't be around today. A friend of mine blacked out yesterday, and I had to rush her to the hospital. She's okay, and she was allowed to come home, but she's supposed to be watched just in case. Her boyfriend has to leave for the rest of the day I'm taking over for the day.

If I could get those who were up in the air to make initiative (those who wish to participate in the fight), as well as spot checks against the gargoyle (DC 30) that's now above probably all of you (he flew 180 feet up perfectly and you know regular gargoyles can't normally do that).

Just to let everyone know, we've got one month left to complete this so I have enough time to adjust it and whatnot, if need be, for the convention on June 3rd.

After that, I've gotta start in on the sequel to this. If anyone survives this, their character can continue on to that campaign if you'd like. It will actually be an epic level one-shot. I'm thinking ECL 23 or 24, depending on how things work out.

Also, will you be OK, with me changing Melkior to using spell points either after this battle or after next rest. It's so much better than preparing stuff.

Yes, Alen hit with all of his attacks, and yes the thing did survive 8 negative levels. It didn't take 11 levels though. I asked, and it's always rounding down. The answer was

1 stays 1, 2 becomes 3, 3 becomes 4, and 4 becomes 6. Remember, you ALWAYS round down.
As well, one of the rays didn't hit the touch AC of 24.

Truth be told I always thought you were using spell points, and not preparing your spells individually. So if you want to change it now, and adjust things, by all means.
