A gestalt character
Also, you can't take the same class on both sides (or maybe I'm wrong, I can't find anything about it).

Optimizing is the antithesis of roleplaying because it takes focus away from the important parts of the game.
I'm inclined to disagree. People work hard on there characters, there personality, back ground, appearance, so forth. No one wants there character that they have invested time, energy, thought, and probably emotion in to be killed because they didn't take strong enough feats or skills or spells or what have you.

There's nothing saying you can't take a base casting class at the same time as a level in a casting PrC that doesn't progress the base class, though.

Such as psion//constructor 1.

I've decided to change things and go wit hthe followin build:

NG Human Lich Dread Necromancer 20 / Rainbow Servant +1 // Spellthief 4 / Bard 1 Dread Witch 5 / Knight of the Weave 1 / Rainbow Servant 9 of Mystra

This gives me 4 Cha-based spontaneous arcane spellcasting classes w/ access to cleric spells and 3 domains  :devil

This is my first ever bard, any suggestions?

Take stand up comedy as your perform skill, pluck a note on a banjo and deliver a horrible pun at the start of each combat.

Don't think dancing qualifies, wanna stay strictly within the rules as you annoy/amuse everyone. Instrument + spoken performance qualifies, and a single note on a banjo along with a horrible pun has a certain absurd panache to it. A kazoo would do in a pinch.

SRD allows dance options... maybe the MC Hammer dance instead?

"Can't touch this!" seems like a challenge the dm could easily beat (with a thrown book, or with an optimized mob, one way or the other) but "2 legit to quit" seems safe

That feat in Dragonlance that lets you uncap all your spells?

 :o ... what ?!
Reserves of Strength. You can increase your caster level by a maximum of three for the price getting stunned or, if immune, taking minor damage. It explicitly allows you to break the caps. So if you have a CL of 47 and increase it by three to cast Fireball you will deal 50d6 damage. It is rather nice with, say, Shapechange.

But if you DM reads the feat conservatively then, the cap only applies to the caster level increase from the feat itself, because it has kind of a fuzzy phrasing

This is my first ever bard, any suggestions?

Name:  Horatio Caine (looks like David Caruso)
Magic Items:  Goggles of Day (aka sunglasses)
Performance skill: "The one liner"

Deliver a one liner at the beginning of every encounter and put on your goggles of day.  Yell "YEEEEAAAAAHHHH!"
Make sure you take ranks in gather information and knowledge (crime scene) to further emphasize how awesome you are.

Constantly talk about Miami, the mythical city you come from.

Note that your cleric spells are cast as divine spells.

And you have a rebuking pool.

Yeah, which could get interesting, having Master Spellthief work on divine spells

NG Dread Necromancer / Rainbow Servant

I think you'd have to be neutral to qualify for both, wouldn't you?

Dread necromancers can't be good.  The rationale is that they have a lot of [evil] spells on their list, so it seems to be more of an "obvious inevitability of having these spells" thing rather than actually being powered by evil.  There's no consequence listed for changing alignments, and LN or TN works for both.

If you can use Tome material, Seeker of the Lost Wizard traditions uncaps all your spells. I realize this is a shaky proposition, though.
